Open Office Days for Tier II Reporting Assistance

The Oxford County Emergency Management Agency, in conjunction with the Oxford County LEPC, would like to invite you to stop by their office on one of two open office days to assist you with filling out your Tier II Report. Tier II reports were due in on March 1, 2008, so this is a great opportunity to help you fill out your forms and become compliant with the Federal Law requiring hazardous material reporting if you have yet to do so. You may drop in at any of the following times, no appointment necessary. 

Open Office Day 1: April 7, 2008
Time:    10 am – 12 pm or
1 pm – 3 pm

Open Office Day 2: April 9, 2008
Time:    10 am – 12 pm or
1 pm – 3 pm

It should not take more than a half hour to fill out your report as long as you have all of the information with you. You will need to bring:

-         Facility Addresses

-         Emergency Contacts with addresses and phone numbers (One must be the Owner/Operator and another your supplier)

-         Your Dun & Bradstreet or SIC Number

-         Chemical name, physical state, days on site, hazards and health effects (acute or chronic)

-         Maximum and average daily amounts of each chemical (in pounds, not gallons) along with the amount the largest on site container will hold

-         Storage type, pressure, temperature. (Ex. Above ground, ambient temperature and ambient pressure)

-         Description of location of chemical on site

-         Mixture components if you are reporting a mixture

-         Mode of shipment (to your facility), frequency of shipment, maximum capacity in a single vessel, physical state in transit, maximum and average amount in shipment, primary routes to your facility and your carrier

The Oxford County Emergency Management Agency office is located in the basement of the Superior Courthouse at 26 Western Avenue in South Paris. There will be computers provided to complete your report electronically, and assistance will be given on a first come, first served basis. A Facility Guide to the Emergency Planning and Community Right to Know Act in Maine pdf

This document is designed to help a facility owner or operator comply with the reporting requirements of the Emergency Planning and Community Right-To-Know Act (EPCRA), Title III of the Superfund Amendments and Reauthorization Act of 1986, 42 U.S.C. s. 11001, et seq. (SARA) and the Maine Hazardous Materials Emergency Response and Community Right-to-Know Act of 1988, MRSA Title 37B Chapter 13.  Any facility, public or private, that has present hazardous materials at or above established threshold amounts may potentially be subject to this law.  Because EPCRA is complex and has multiple reporting requirements, the State Emergency Response Commission (SERC), a policy board appointed by the Governor, developed this manual to assist facilities in meeting the state and federal requirements.


Hazardous Chemical Facility Compliance

Federal and State Emergency Planning and Community Right-to-Know laws specify that facilities with inventories of hazardous chemicals above 10,000 pounds, (that's about 1500 gallons of many liquid products) or Extremely Hazardous Substances (EHS) at 500 pounds or the listed Threshold Planning Quantity (TPQ) whichever is less for each chemical must report those inventories to the local fire department, the Local Emergency Planning Committee (LEPC), and the State Emergency Response Commission (SERC) annually. In addition, if you exceed the TPQ of an EHS chemical you are also responsible for the development of an emergency plan and an annual review and exercise of that plan along with ensuring that your local FD, LEPC and the SERC have copies of your plan.

The following schedule identifies specific reporting requirements and the appropriate forms which must be completed:

October 1→Annual Registration Fee (Yellow Worksheet)
March 1→Chemical Inventory Reporting Forms (Tier 2 Submit software) (White Form)
March 1→Annual Inventory Fee (Pink Worksheet)
July 1→Toxic Chemical Release Inventory Reporting Forms (US EPA "Form R" or "Form A")
July 1→Annual Toxic Release Inventory Fee (Blue Worksheet)

Maine now requires electronic reporting using the EPA's Tier 2 Submit software. Along with submissions to the SERC, each LEPC will accept electronic reporting.

The electronic submission can be sent to MEMA by emailing the file(s) to maine.serc@maine.gov or by mailing the file(s) to MEMA on a disk or CD (72 State House Station, Augusta, ME 04333-0072). The electronic submission can be sent to Oxford County EMA/LEPC by emailing the file(s) to oxctyema@megalink.net or by mailing the file(s) to Oxford County EMA/LEPC on a disk or CD (PO Box 179, 26 Western Av., South Paris, ME 04281). Please continue to submit paper forms to your local fire department(s). The Tier 2 Submit software download, and information regarding the software is located at http://www.epa.gov/emergencies/content/epcra/tier2.htm. Workshops have been scheduled throughout Maine on how to use the Tier 2 Submit software and for reporting assistance. The US EPA has produced a Title III "List of Lists" to assist in identifying Extremely Hazardous Substances and their thresholds, the Reporting Quantities for spill notifications, as well as chemicals reportable under the Toxic Chemical Release Reporting requirements. Copies are available from the Maine Emergency Management Agency at no charge.
